Terms of Use

1. Acceptance of Terms

By creating an account or using Flashcards (the "Service") you agree to these Terms of Use. If you do not agree, do not use the Service. These Terms form a binding agreement between you and the Flashcards team (the "Provider").

2. The Service

Flashcards is a web application that lets you build personal vocabulary decks, study them with adaptive sessions, share them with other users, and view learning statistics. The Service is provided on a freemium model: a free tier with usage limits and an optional one-time Pro upgrade.

3. Account & Eligibility

• You must be at least 13 years old to create an account.
• You must provide a valid email address and accurate information.
• One account per person; accounts are non-transferable.
• You are responsible for keeping your password confidential and for all activity under your account.
• You must verify your email address before initiating a Pro purchase.
• Notify us promptly at hello@flashcards.best if you suspect unauthorised access.

4. Free & Pro Plans

The free plan is limited to 10 decks and 10 cards per deck. Pro removes these limits and unlocks all current and future features.

• Price: a one-time payment of 100 ₴ (subject to change for new buyers; current price is shown on the pricing page).
• Term: lifetime access for the account that made the purchase. No subscriptions, no recurring charges.
• Transferability: Pro entitlement is non-transferable between accounts.
• Future features: we intend to keep adding to Pro at no extra cost, but we do not warrant any specific future feature.

5. Payments

• Payments are processed by Monobank (plata by mono), a regulated Ukrainian payment service.
• You are redirected to Monobank's secure page (pay.mbnk.biz) to enter card details. We never see or store them.
• Pro access is activated automatically once Monobank confirms successful payment via signed webhook (status success).
• If a payment is declined, expired, or reversed by Monobank, no Pro access is granted.
• The charge may appear on your statement as "Flashcards" or "plata by mono".

6. Your Content

You retain full ownership of the vocabulary decks, entries, and translations you create ("Your Content"). By using the Service you grant the Provider a limited, worldwide, royalty-free licence to store, transmit, and display Your Content solely for the purpose of providing the Service to you and to recipients you have invited.

You represent that Your Content does not infringe the intellectual-property, privacy, or other rights of any third party. You are solely responsible for backing up Your Content; we offer export on request but do not guarantee restoration of deleted data.

7. Acceptable Use

You agree not to:

• Upload content that is illegal, infringing, hateful, harassing, defamatory, or sexually explicit involving minors.
• Use the Service to send unsolicited bulk invitations or spam.
• Attempt to access another user's account or data.
• Reverse engineer, decompile, scrape, or programmatically extract data from the Service.
• Disrupt the Service, probe for vulnerabilities, or evade rate limits.
• Resell, sublicence, or commercially exploit access to the Service.

We may suspend or terminate accounts that violate this section, with or without notice.

8. Sharing Decks

When you share a deck, the recipients you invite can view and study its contents. You are responsible for what you share and with whom. Recipients of shared decks must comply with these Terms when interacting with Your Content.

9. Intellectual Property

All application code, design, branding, logos, and trademarks (excluding Your Content) are the property of the Flashcards team. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial vocabulary learning.

10. Service Availability & Changes

We work to keep the Service available, but we do not guarantee uninterrupted, error-free operation. We may add, modify, or discontinue features at any time. If we discontinue the Service entirely, we will give Pro users reasonable advance notice and, where practical, an export of their data.

11. Termination

You may delete your account at any time from Settings → Danger zone. We may suspend or terminate your account for breach of these Terms, for legal compliance, or in cases of suspected fraud or abuse. Termination does not entitle you to a refund except where required by law or under our Refund Policy.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy of learning content, or non-infringement. We do not warrant that the Service will meet your learning goals.

13. Limitation of Liability

To the maximum extent permitted by law, the Provider's total aggregate liability arising out of or related to the Service is limited to the amount you paid for Pro (currently 100 ₴) or, if you are on the free plan, 0 ₴. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, even if advised of the possibility.

14. Governing Law & Disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. The parties will attempt to resolve any dispute through good-faith negotiation by email first. If unresolved within 30 days, the dispute may be brought before the competent courts of Ukraine.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Material changes will be highlighted in-app or by email. Continued use of the Service after an update constitutes acceptance of the revised Terms.
